Lawsuit Over Septic Pollution Could Disrupt Mashpee Real Estate Market | Mashpee News


Nitrogen pollution from septic systems is at the center of a lawsuit filed in Barnstable Superior Court on Wednesday, June 16, that could upend the real estate market in Mashpee.

The lawsuit by the Conservation Law Foundation names the Town of Mashpee, the Town of Barnstable and the Massachusetts Department of Environmental Protection as defendants and seeks a court order to halt septic installations and inspections in both towns temporarily.

The CLF argues in the lawsuit that the towns and MassDEP have violated state law related to Title V of the Massachusetts Environmental Code by signing off on installation and inspection of septic systems that are known to be the primary source of pollution in the region’s waterways.
